Terms of Use

1. License Grant

Subject to your compliance with these Terms, AMO Gaffer grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Pocket Console for your personal or commercial use on Apple devices you own or control, as permitted by the App Store Terms of Service.

2. Subscriptions & Purchases

Programming in Pocket Console is free. Live DMX output is unlocked by a paid plan — Pocket (1 universe), Plus (4 universes), or Pro (256 universes) — offered as an auto-renewing monthly or annual subscription, or a one-time Lifetime purchase.

• Payment is charged to your Apple Account at confirmation of purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel subscriptions in your device Settings ▸ Apple Account ▸ Subscriptions at any time.
• Where offered, the free trial's unused portion is forfeited when you purchase a subscription.
• A Lifetime purchase is a one-time payment that unlocks its tier for the supported life of the app on the App Store. It is not a subscription and does not renew. "Lifetime" refers to the lifetime of the product.
• Upgrades, downgrades, refunds and billing are handled by Apple under the App Store terms.

3. Restrictions

You may not:

• Copy, modify, or create derivative works of the software
• Reverse engineer, decompile, or disassemble the software
• Rent, lease, lend, sell, or redistribute the software
• Remove any copyright or proprietary notices
• Use the software for any unlawful purpose

4. Ownership

Pocket Console and all intellectual property rights therein are and shall remain the property of AMO Gaffer. These Terms do not grant you any rights to trademarks, service marks, or logos.

5. Critical Use Disclaimer

IMPORTANT: Pocket Console controls lighting in live production environments. You acknowledge that:

• This software is a tool that requires proper operation, patching and configuration
• You are solely responsible for testing and verifying output before any live use
• You should always have backup systems and contingency plans
• Software and networks can fail, and you assume all risks associated with such failures
• Pocket Console must not be used to control safety-critical systems (rigging, pyrotechnics, interlocks, or anything whose failure could cause injury)

6. Warranty Disclaimer

POCKET CONSOLE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMO GAFFER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND RELIABILITY. AMO GAFFER DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AMO GAFFER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, OR USE; BUSINESS INTERRUPTION; PRODUCTION DELAYS OR SHOW FAILURES — ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE POCKET CONSOLE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL AMO GAFFER'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Updates and Support

AMO Gaffer may, but is not obligated to, provide updates, upgrades, or support. Updates are subject to these Terms unless accompanied by a separate license.

9. Termination

These Terms are effective until terminated. Your rights terminate automatically if you fail to comply with any term. Upon termination you must cease all use of Pocket Console.

10. Governing Law

These Terms are governed by the laws of the United States and your local jurisdiction, without regard to conflict of law principles.

11. Entire Agreement & Changes

These Terms are the entire agreement between you and AMO Gaffer regarding Pocket Console and supersede all prior agreements. AMO Gaffer may modify these Terms; continued use after changes constitutes acceptance.
